The Commission on Administrative Justice has now called for the immediate dismissal of officers who admitted wrongdoing and has referred both the implicated officers and bribe givers to the Ethics and Anti-Corruption Commission (EACC) and the Directorate of Criminal Investigations (DCI) for further action.
In a statement issued on Friday, the Commission said the arrests follow investigations into the irregular award of Tender No. HBCA/T/W6/2018-2019, which was allegedly marred by abuse of office and violations of procurement laws.
The accused face charges under the Anti-Corruption and Economic Crimes Act, 2003, including abuse of office, willful failure to comply with procurement laws, conflict of interest, and unlawful or fraudulent acquisition of public property. The arraignment of the accused is expected in court as the prosecution prepares its case.
The commission cited the Leadership and Integrity Act, its regulations, and the Public Service Code of Conduct and Ethics to justify the suspension, noting that officers facing serious allegations can be temporarily removed while investigations continue.
The freeze in funding is affecting critical sectors, including energy, social welfare, and oversight agencies, slowing down both planned initiatives and ongoing programmes.
The EACC said the arrests are part of its ongoing nationwide efforts to combat bribery on major roads, particularly during festive periods when travel volumes rise and motorists are at higher risk of exploitation.
Justice Nixon Sifuna, who delivered the ruling, partially allowed a civil case filed by the Ethics and Anti-Corruption Commission (EACC) seeking to recover wealth allegedly acquired illegally during Waititu’s tenure. The commission had sought the seizure of assets totaling Sh1.9 billion, but the court approved confiscation of only those for which there was insufficient explanation regarding their source.
