The senator said the allocation of Sh2 billion had offered hope to families affected by protest-related violence, but many continue to struggle with the loss of loved ones, injuries, trauma and uncertainty over when or whether they will receive compensation.
The decision, delivered in Nairobi on Friday by Justices W. Karanja, F. Tuiyott and W. Korir, reinforces an earlier ruling by the Environment and Land Court (ELC), which found that the land on which the two schools sit had already been surrendered to the Government and therefore remained public land.
The panel said compensation is only being issued to victims who have completed the verification process and formally agreed to participate in the programme.
The Sh2 billion allocation, approved by Parliament, will be used to support verification, assessment, and payment of qualified claims under strict guidelines.

Speaking during the presentation of the Report on the Framework for Reparations for Victims of Human Rights Violations at State House, Nairobi on Monday, Mutua said the claims, drawn from oversight bodies and state agencies, are being processed through what he described as an “AI integrated case management system” designed to ensure transparency, accountability and full auditability of the reparations process.
In the gazette notice dated June 4, the government said the decision was intended to allow the experts to conclude their work on a matter that has drawn significant public interest.
More than 5,000 former civil servants are asking the court to enforce a 2012 High Court ruling on unlawful retrenchment. They want Sh1.6 billion, while Treasury cites delays verifying claims across ministries.
Commissioner Marion Mutugi said the list includes both those who lost their lives and those who suffered injuries during various protest episodes, adding that the government is expected to act on the documentation without delay.
The Commission stressed that all its services are free of charge and that no payments are required at any stage of engagement with victims or complainants.
The carrier had been in discussions with the US government over a possible lifeline that would have helped it stay afloat after months of financial pressure.
In a public notice issued on Monday, the Commission said the proposed guidelines are part of a broader reform agenda designed to strengthen access to justice and redress.
