The petitioners, comprising Bunge la Mwananchi and individuals Lawrence Oyugi, Komeade Bush, and Nicholas Kimanzi, have urged the Court to issue an order suspending Governor Kahiga from carrying out his duties until the case is resolved. The petitioners argue that Kahiga’s continued hold on office would allow him to perpetuate further inflammatory statements, undermining national cohesion.
The petitioners argue that exempting Cabinet secretaries and county executives from political restrictions is discriminatory since other State officers are barred from supporting or opposing any political interests or engaging in partisan activities.
Besides KNTC, the petition names the Treasury and Agriculture Cabinet Secretaries, the Agriculture Food Authority, the Commissioner for Customs and Border Control, the Attorney General, and the Kenya Ports Authority (KPA) as respondents.
The case had been filed by Michael Onyango Otieno, who sought a declaration that interring Odinga within 72 hours contradicted the Constitution. He argued that such haste breached Article 44, which protects the right of every person to engage in their community’s cultural life.
The petition, submitted by Nakuru-based civic activist Laban Omusundi, argues that counties have engaged lawyers without following proper procedures, bypassing in-house legal teams and established procurement rules. Omusundi contends that this practice has led to massive financial losses and undermines the ethical standards expected of legal professionals.
The unions recall that on October 28 2019, the Inter-Public Universities Councils Consultative Forum (IPUCCF) and UASU signed the 2017-2021 Collective Bargaining Agreement (CBA), which was subsequently registered with the Employment and Labour Relations Court.
The organisation, which brings together more than 70 civil society groups and thousands of cancer patients, urged lawmakers to strengthen oncology benefits and increase allocations to the Primary Healthcare Fund as well as the Emergency, Chronic and Critical Illness Fund.
Supporting the petition, Tom Gichuhi, Executive Director of the Association of Kenya Insurers (AKI), said fraud and price competition have made PSV insurance financially unviable.
The petitioners argue that the lack of formal oversight has allowed substandard institutions to operate freely, contributing to tragedies like the Shakahola massacre.
With the objection dismissed, the case will now proceed to a full hearing, with submissions scheduled for November 17, 2025.
In his petition, Omusundi called on the commission to openly recognize the risks posed by spyware and AI-driven interference, insisting that the threat model should cover all electoral assets.
The notice was submitted through her lawyer, Ombaso, before Justice Chacha Mwita at the Milimani Constitutional and Human Rights Division, who granted the request and formally closed the case.
