The inquiry followed an order in April 2025 by Health Cabinet Secretary Aden Duale, who suspended kidney transplant services at the Eldoret-based Mediheal facility after complaints emerged over possible breaches of medical and ethical standards. Mediheal Group of Hospitals is associated with former Kesses Member of Parliament Swarup Mishra.
He made it clear that Mediheal does not take part in selecting donors or influencing patients in any way.
The investigators discovered that only one in four kidney‑transplant centres had a fully trained and dedicated multidisciplinary team, while nearly half operated without Standard Operating Procedures.
Alarmingly, the nationality of 38.9 per cent of the donors could not be verified in the report, with 60 individuals failing to disclose their country of origin.
Duale said the government would fully adopt the committee’s recommendations and ensure that all medical procedures adhere to ethical standards and protect patient safety.
The court found that the hospital failed to pay the workers’ salaries for several months, forcing them to resign under pressure — a move ruled as constructive dismissal.
Duale said the two officials tampered with the committee's final report, prompting some members of the team to decline to sign the document, rendering it unofficial and without any legal or administrative standing.
The committee, led by Prof Elizabeth Bukusi, is gathering evidence on the state of organ transplant services in the country. In Uasin Gishu, the team is focusing on claims tied to kidney transplants, with Mediheal Hospital named in connection to some of the cases.
The hospital’s lawyers Katwa Kigen and Conrad Maloba delivered the documents on Wednesday to officers from the Transnational Organized Crime Unit at the DCI headquarters.
