According to the Directorate of Criminal Investigations (DCI), the suspect Maitha spent months parading himself under the stolen identity and presenting himself as the bona fide owner of the lucrative property.
The suspects was arrested on Wednesday, August 19, in Ruiru, where she had attended a defence hearing in a separate land fraud case also being investigated by the LFIU.
The investigation was launched after a family member lodged a complaint on behalf of his siblings, alleging that the two suspects had transferred valuable family properties into their own names and those of companies linked to them
The convictions, handed down by the Milimani Law Courts, followed investigations into forged land records, fraudulent property transfers and other illegal land dealings that deprived legitimate landowners of their property
The suspect was arrested in an intelligence-led operation at Jacaranda Hotel in Nairobi's Westlands area by detectives from the DCI Headquarters Land Fraud Investigations Unit (LFIU). The arrest followed investigations into the alleged fraudulent acquisition of the prime parcel of land located along Mua Park Road in Muthaiga.
According to the DCI, the complainant bought the parcel of land in 2005 and had remained in peaceful possession of it for years before discovering that its ownership had been challenged through court proceedings
According to the DCI, investigations revealed that Daimler Enterprises Limited had laid claim to the same property despite records from the Ministry of Lands confirming the complainant as the rightful owner.
Authorities explained that the parcel was subdivided without the consent of the purchasers, prompting them to file a complaint and seek investigations
In the ruling, the court declared as irregular proceedings in which a senior prosecutor had been compelled to appear before the Kajiado Law Courts to explain the basis of a decision to charge suspects in the case. Warrants of arrest issued against the prosecutor for allegedly failing to honour the summons were also quashed.
Githiari was apprehended by officers from the DCI Headquarters’ Land Fraud Investigation Unit (LFIU) at his Karen residence on Thursday and is expected to be arraigned before the Milimani Law Courts on Friday, May 15, 2026.
DCI detectives arrested Skyline Works Ltd director Abdul Hassan Tahalil over an alleged land fraud scheme involving forged documents in Eastleigh, Nairobi. DCI says the file was sent to ODPP for prosecution and he remains in custody.
The suspect, identified as Francis Maina Ndegwa, is alleged to have forged signatures of officials in a plot to evict the rightful owners of a property valued at Sh50 million. He is currently in custody awaiting arraignment.
