In the notices, the Commission confirmed that Mitkei and Tembelio Wards will not have ballots cast. The two areas were declared uncontested, meaning the nominated candidates will take up their seats without undergoing a competitive vote, a process permitted under election rules where only one valid candidate is presented.
According to the Commission, a recall can only take place on weighty grounds such as gross misconduct, violation of the Constitution or other laws, incompetence, or conviction for a criminal offence punishable by a prison term of six months or longer.

According to the directives issued by Chairperson Erastus Edung Ethekon, any nomination disputes must be resolved within ten days of being lodged and not later than October 21, 2025.
Data from the Commission shows that Nairobi County led in new voter registrations with 4,804, followed by Mombasa at 1,379, Kiambu 1,203, Machakos 923, and Kakamega 608. Other counties making significant contributions included Murang’a (588), Siaya (564), Busia (427), and Laikipia (165).
According to the guidelines issued, campaign activities will officially end on Monday, November 24, 2025, 48 hours before the by-election date. The commission further directed that campaigns shall only take place between 7 am and 6 pm each day until then.
The group also wants the commission to confirm whether a Data Protection Impact Assessment was conducted before the iris scan system was introduced and to clarify which systems or external parties, if any, can access the biometric data, as well as the safeguards in place to prevent misuse.
PS Omollo added that the government has deployed sufficient security personnel and is working closely with the Independent Electoral and Boundaries Commission (IEBC) to coordinate operations ahead of polling day.
Mulle Musau, National Coordinator of the Elections Observation Group (ELOG) stressed that with less than two years to the polls, many critical tasks, including finalizing electoral boundaries, remain incomplete.
