The DPP has charged William Imoli alias Imo, Edwin Odour Odhiambo alias Machuani, Ebel Ochieng alias Dave Calo, Isaac Kuria and Allan Ogola with the offence of murder. They are accused of killing Ong’ondo Were on the night of April 30, 2025, at around 7.40 p.m.
In a ruling delivered by Senior Resident Magistrate Paul Mutai, the court held that evidence presented showed Salasya had met all the requirements under an out-of-court agreement, including issuing a public apology and actively participating in peace initiatives.
The accused; Jaseem Darzadeh Nia, Nadeem Jadgal, Hassan Baloch, Raheem Baksh, Imran Baloch, and Imtiyaz Daryay; appeared before Chief Magistrate Anthony Mwicigi, requesting that the charges be read afresh, claiming they had not fully understood them when they initially pleaded guilty a fortnight ago.
In a judgement delivered by Resident Magistrate Hon. Flavian Mulama, Diana Akinyi Simiyu was found guilty of trafficking in persons contrary to Section 3(1) as read with Section 3(5) of the Counter-Trafficking in Persons Act, 2010. The court ruled that the prosecution had proved its case beyond reasonable doubt.
The three wardens were convicted on multiple counts, including neglect of official duty, aiding prisoners to escape, and facilitating gatherings in support of a terrorist organisation — offences that the court described as posing a “grave threat to national security.”
In a ruling delivered on Monday, Malindi Senior Principal Magistrate Joy Wesonga allowed the prosecution additional time to coordinate the production of all suspects, paving the way for a joint plea-taking scheduled for February 11, 2026.
