Justice Katwa Kigen is among the newly elevated judges and has been assigned to the Nyeri station. Ahmed Isaack Hassan, who previously served as chair of the Independent Policing Oversight Authority, has been posted to Nakuru under the same placement schedule.
The appellate court noted that the High Court failed to conduct a thorough analysis of the Act against constitutional principles, particularly regarding devolution, public finance, and the separation of powers. It further observed that the amendments made to the NGCDF Act in 2022 and 2023 did not nullify the issues raised in the petition.
The appointments, made under Article 166(1)(b) of the Constitution, were published in a special issue of the Kenya Gazette dated January 27, 2026.
With the court’s approval, Multichoice can now ask the Supreme Court to examine a January 2025 ruling that allowed criminal prosecutions against architects and engineers to continue alongside civil litigation and arbitration.
