The matter arises from investigations that were finalized in October 2022 following a judicial inquest into incidents recorded between August 11 and 15, 2017, after the presidential election results were announced. Those findings later formed the basis of prosecutions under the International Crimes Act.
The court further ordered the National Police Service to provide security for both witnesses and the accused during transport and hearings.
According to the court submissions, the DPP intends to call more than 80 witnesses, most of whom are Kisumu residents.
During a hearing on Thursday, July 17, the High Court was informed that all parties had agreed to the relocation, except the third accused, who has not filed any submissions or formal objections.
The court further directed that each of the accused must provide two sureties, each valued at five hundred thousand shillings.
The High Court issued the directive on Monday following concerns raised over potential contact between the accused and victims of the violence.
The DPP informed the court that it had examined the case afresh and decided to amend the list of suspects.
The officers face 47 counts of crimes against humanity, including murder, torture, and rape.
