The matter, which was first filed in 2022, has remained unresolved for almost four years, causing frustration for the Kenya Railways Staff Retirement Benefits Scheme trustees.
The Attorney General’s Office clarified that both the public and authorized marriage officers will now handle all applications and downloads through the government’s official eCitizen platform at www.ecitizen.go.ke.
The appointments came after extensive consultations between Attorney-General Dorcas Oduor and Muslim organizations, including the Jamia Mosque Committee, the Supreme Council of Kenya Muslims (SUPKEM), NAMLEF, and CIPK. The panel’s role under the Waqf Act 2022 is to ensure that competent and qualified individuals are appointed to the Waqf Commission, tasked with managing Waqf assets responsibly and enhancing accountability.
According to the AG, the data in question would be shared in a summarised and de-identified form for purposes such as monitoring, evaluation, public reporting and planning. She explained that aggregated data does not contain personal identifiers and cannot be linked back to any individual.
The affected employees, drawn from Chemilil Sugar Company, South Nyanza (Sony) Sugar Company, Muhoroni Sugar Company, and Nzoia Sugar Company, filed a lawsuit arguing that the redundancy notices were issued in the midst of ongoing discussions about their benefits.
According to Attorney General Dorcas Oduor, access to justice remains a cornerstone of Kenya’s democracy but continues to elude many citizens due to high legal fees, complex court procedures, and limited access to legal services.
The guidelines include streamlining the legal processes, harmonising the procedures, accelerating adjudication and having a consistent and predictable judicial officers in Special Magistrates’ Courts.
The decision came after the court heard that despite being served two months ago, the State had not filed any formal response.
The changes affect key councils and boards that oversee national examinations, special education, biosafety, teacher training and legal education.
Justice Mwita directed the petitioners to file and serve the supplementary affidavit within seven days, with the Attorney-General’s office given the same period to reply if necessary.
Justice Chacha Mwita made the ruling on Thursday, June 12, stating that the matter raises serious constitutional and legal issues that must be fully examined before any changes can be implemented.
