Man jailed 20 years for defiling 14-year-old girl in Taita-Taveta

A Taita-Taveta man has been sentenced to 20 years in prison after a court found him guilty of defiling a 14-year-old girl in two separate incidents in August 2023.

Musyoka Paul was convicted after the prosecution presented evidence that he sexually assaulted the minor at Chumvini Village in Taita-Taveta County. The case was prosecuted by the Office of the Director of Public Prosecutions (ODPP), which said it had proved the charges beyond reasonable doubt.

Taveta Senior Principal Magistrate Cecilia Kithinji handed down the sentence on Wednesday after hearing the case, in which Musyoka faced a charge of defilement contrary to Section 8(1) as read with Section 8(3) of the Sexual Offences Act No. 3 of 2006.

He also faced an alternative charge of committing an indecent act with a child contrary to Section 11(1) of the same law.

During the trial, the court heard how the girl first came across Musyoka while she was walking home from a shopping centre.

The minor told the court that Musyoka confronted her along the roadside while armed with a knife. She said he grabbed her by force, pushed her to the ground and sexually assaulted her.

She further testified that Musyoka threatened to kill her during the attack.

The court was also told that Musyoka confronted the girl on another occasion when she was coming back from the toilet. According to her evidence, he was again carrying a knife and sexually assaulted her.

The ODPP said the prosecution, led by Charles Mogaka and Louane Lwane, called four witnesses, among them the minor, to support the case.

After reviewing the evidence presented before the court, Magistrate Kithinji ruled that the prosecution had established the case against Musyoka beyond reasonable doubt and convicted him.

She then sentenced him to 20 years in prison. Musyoka was also given 14 days to appeal either the conviction or the sentence.

The sentence is in line with Section 8(3) of the Sexual Offences Act, which provides for a minimum prison term of 20 years for a person convicted of defiling a child aged between 12 and 15 years.

Kenyan courts have continued to apply the provision in cases involving children within that age group. A 2026 High Court decision also reaffirmed that the statutory minimum sentence for defilement involving a 14-year-old child is 20 years.

For a defilement case to succeed, the prosecution is required to prove key elements, including the child's age, penetration and the identity of the person responsible.

The case comes amid wider concerns over sexual violence against children in Kenya.

The 2019 Kenya Violence Against Children Survey found that nearly one in six females had experienced sexual violence during childhood. Among girls aged between 13 and 17, 13.5 per cent said they had experienced some form of sexual violence in the 12 months before the survey.

The survey further found that 15.6 per cent of females aged between 18 and 24 had experienced sexual violence before turning 18. Of those who reported such experiences, 62.6 per cent said they had suffered multiple incidents.

The findings have since been used to guide government efforts aimed at improving the prevention, reporting and response to violence against children.

In Musyoka's case, the ODPP said the evidence given by the four witnesses established what happened during the incidents and supported the conviction.

His 20-year prison sentence will remain in place unless he succeeds in challenging the conviction or sentence through the appeal process.
