Court stops arrest, prosecution of three over Manzil Towers collapse

The High Court has temporarily halted the arrest, charging and prosecution of three individuals linked to the collapse of Manzil Towers C in South C, Nairobi, pending the determination of their judicial review application.

The building collapsed on January 2, 2026, killing two people and injuring several others.

Justice Dr. Nabil Mokaya Orina allowed Patrick Analo Akivaga, David Kibui Kigathi and another applicant to challenge the Directorate of Criminal Investigations’ decision to press criminal charges against them.

The three are seeking to overturn charges of abuse of office under Sections 101(1) and 102A of the Penal Code, while the third applicant is also challenging a charge of neglect of official duty arising from the same incident.

The court granted them permission to seek orders barring the DCI and other authorities from arresting, charging or continuing with criminal proceedings against them over the building collapse.

Justice Orina directed the applicants to file their substantive application within seven days, with the respondents given 21 days to respond.

The matter will be mentioned on September 16, 2026, for compliance and further directions.

The court order effectively suspends the charge sheet dated July 14, 2026, until the judicial review case is determined.
