The clock is now ticking for the Office of the Director of Public Prosecutions (ODPP) to decide the fate of lawyer Angela Mulwa and Nelson Masiga over allegations linked to a Range Rover taken from a disputed 21-acre piece of land in Mlolongo.
The Mavoko Law Court has allowed the prosecution seven days to complete its investigations and decide whether the two should be charged.
The order was issued during a mention on Wednesday, with the court directing the ODPP to conclude the inquiry and take the necessary action within the period given.
The court also made it clear that failure by the DPP to make a decision within the seven days will result in Mulwa and Masiga being released unconditionally.
The case concerns a Range Rover and the 21-acre property said to have belonged to Dr Victoria Mutiso, who was shot dead on July 29, 2026.
The allegations over the vehicle have added another layer to investigations surrounding Mutiso's death, with the prosecution yet to make a final decision on whether the two suspects will face charges.
Masiga has meanwhile approached the DPP with a request to be admitted as a state witness. The request has not yet been determined.
He remains at Mavoko Police Station as he completes the processing of his bond.
Mulwa's situation has also changed since she was granted bail. She had been released on a Sh1 million bail but was taken back into custody on Thursday evening by Directorate of Criminal Investigations (DCI) homicide detectives.
Her latest arrest is over the death of Dr Mutiso, whose property is also at the centre of the allegations being investigated.
The court is expected to revisit the matter on September 2 when it will give further directions.
Until then, the ODPP is expected to determine whether the evidence gathered is enough to bring charges against Mulwa and Masiga. If no decision is made within the deadline, the court has already ordered that the two be discharged without conditions.
