A High Court has sentenced Salim Hukicho, a 44-year-old man from Garsen in Tana River County, to 25 years in prison after convicting him of murdering his neighbour over allegations that he was having an affair with his wife.
The sentence followed a murder trial in which the Office of the Director of Public Prosecutions (ODPP) proved the case beyond reasonable doubt through witness testimony and medical evidence, with the court finding that the fatal attack was driven by the accused's mistaken belief.
Justice Jesse Nyaga convicted Salim Hukicho of murder contrary to Section 203 as read together with Section 204 of the Penal Code before imposing the custodial sentence.
The court heard that the fatal incident occurred on the evening of September 4, 2022, in Tarasaa Township, when the accused allegedly confronted the victim, Hassan Rona, at his house.
According to the prosecution, the attack was unprovoked and resulted in fatal injuries.
"The court heard that on the evening of September 4, 2022, in Tarasaa Township, Hukicho ambushed and attacked Hassan Rona in his house and, without provocation, stabbed him in the abdomen. The attack was so vicious that the victim's intestines protruded from the wound, causing the deceased to die on the spot."
Members of the public responded immediately after the incident, taking the accused to Tarasaa Police Station before transporting the victim to Malindi Subcounty Hospital.
However, medical personnel pronounced Hassan Rona dead on arrival.
The prosecution relied on medical evidence to demonstrate the cause of death, with the court finding that the injuries sustained during the attack directly resulted in the victim's death.
During sentencing, Principal Prosecution Counsel Agather Mkongo urged the court to impose a punishment that would reflect the gravity of the offence and discourage similar acts of violence.
The prosecution argued that the brutality of the attack and the need to safeguard the public justified a lengthy custodial sentence.
Investigations presented before the court established that the assault stemmed from the accused's belief that the victim was involved in a relationship with his wife.
However, evidence adduced during the trial contradicted that claim.
"Investigations established that the assault was motivated by the accused's mistaken belief that the complainant was involved in an affair with his wife. Evidence presented during the trial showed that the woman was, in fact, the complainant's former girlfriend."
Justice Nyaga concluded that the prosecution had successfully proved every element of the offence beyond reasonable doubt through credible witness testimony and medical evidence.
"Hon. Nyaga found that the prosecution had established every element of the offence through credible witness testimony and medical evidence, leading to Salim's conviction and a 25-year custodial sentence."
The court also informed the convict that he has 14 days within which to lodge an appeal against both the conviction and the sentence if he chooses to challenge the judgment.
The ruling brings to a close a case arising from the 2022 killing in Tarasaa Township and reaffirms the legal consequences of violent crimes resulting in loss of life.
