Court grants DCI 14 days to hold Angela Mulwa, Nelson Masiga in Dr.Mutiso vehicle theft probe

A Mavoko court has granted the Directorate of Criminal Investigations (DCI) 14 days to continue investigating the alleged theft of motor vehicles linked to the late Dr Victoria Nthunya Mutiso, ordering advocate Angela Mulwa and Nelson Masiga Makaralu to remain in police custody as detectives complete their inquiries.

The ruling, delivered on Tuesday by Magistrate Lilian Nyabando, followed an application by investigators seeking more time to pursue investigations into vehicles reported stolen from the deceased and her family. Detectives had initially requested that the two be detained for 21 days.

The application was presented by DCI officer Gilbert Okello of DCI Athi River East Mlolongo, who told the court that additional time was needed to complete investigations into the alleged theft of the vehicles.

After considering the request, the court approved a 14-day detention period instead of the 21 days sought by the prosecution.

Magistrate Nyabando also directed investigators to carry out the investigations without unnecessary delay, noting that the detention order had been issued solely to facilitate the completion of the inquiry.

“The prosecution’s applications succeed in part; the respondents Angela Muluwa and Nelson Masiga shall remain in lawful police custody for 14 days from the date hereof to facilitate completion of the specified investigations,” Magistrate Nyabando ruled.

She also reminded the court that the detention should not be interpreted as proof of criminal responsibility.

“For avoidance of doubt, the court emphasises that these custodial orders shall not be construed as a finding of guilt, as the respondents continue to enjoy the presumption of innocence guaranteed under Article 52A of the Constitution,” the magistrate added.

Angela Mulwa is the daughter of Rose Mbithe Mulwa, also known as Rose Mbithe Ndetei, who had previously been identified as a person of interest in the murder investigation of Dr Victoria Mutiso.

According to documents filed before the court, detectives are investigating allegations of forgery of a land title document contrary to Section 350(1) of the Penal Code, fraudulent eviction, demolition of property and the theft of several vehicles.

Among the vehicles under investigation are a Range Rover Sport registration number KDU 799Y and a Toyota Prado TX registration number KBT 935T. The DCI also says two other vehicles belonging to Professor David Musyimi Ndetei — a Toyota pickup registration number KAK 225K and a Toyota Corolla registration number KAN 506B — form part of the investigations.

Court documents state that the complaint was first reported by the late Dr Mutiso under OB No. 52 dated May 4, 2026. She alleged that on February 12, 2026, their matrimonial home in Mlolongo was raided, demolished and valuables taken away, including the black Range Rover Sport valued at Sh15 million.

Investigators told the court that the vehicle was later recovered at Angela Mulwa's premises while allegedly in the possession of Angela and Nelson.

The DCI further stated that the Range Rover and Toyota Prado belong to the Africa Institute of Mental and Brain Health (AFRIMEB), an institution co-founded by Professor David Musyimi Ndetei and the late Dr Victoria Mutiso.

“That the first two vehicles KDU 799Y and KBT 935T are owned by AFRIMEB, an Institution Co-founded by the Complainants; – Prof. David Musyimi Ndetei and his late wife Dr. Victoria Mutiso who was fatally injured on July 29, 2026, under the circumstances which is actively under investigation by our Homicide Team based at the DCI Headquarters Nairobi who have so far arraigned two suspects before Milimani Law Courts to face Charges of Murder,” part of the application reads.

The prosecution also told the court that Angela and Nelson are expected to undergo forensic digital identification, including the examination of CCTV footage and communication records, as detectives continue investigating the matter.

According to investigators, the families of Professor Ndetei and the late Dr Mutiso lost property valued at about Sh1.5 billion following the alleged unlawful eviction, demolition of their matrimonial home and theft of assets.

Detectives say the incidents are linked to a land dispute under investigation at DCI Mlolongo and maintain that Angela and Nelson became persons of interest after one of the vehicles reported stolen during the demolition was allegedly recovered in their possession.

The matter will be mentioned before the court on August 19, 2026.
